Become A Retailer

By submitting this application you agree to our Terms and Conditions.

If I become an Authorized Retailer, I understand that all invoices must be in good standing and I will also respect the particular terms of Pop's Birding Company and those of each invoice or contract unless mentioned otherwise on the invoice or contract. I also agree that the conditions mentioned herein will be incorporated in each invoice or transaction done.

With regards to Pop's Unilateral Resale Pricing, Warranty and Internet Policy I specifically agree to the following:

• I will not sell, display or advertise Pop's Products for less than the Minimum Advertised Resale Price ("MAP") as set forth in the current Pop's Price List;
• I will not sell Pop's Products to persons other than end-users;
• I will not operate any instrument of electronic commerce including but not limited to e-mail or direct websites in connection with selling Pop's Products without the prior written authorization of Pop's as an Authorized Internet Retailer;
• I will not sell Pop's Products on any third party marketplace or indirect website (Amazon, Walmart, Ebay, Etc.)

I understand that Pop's reserves the right to unilaterally determine which Retailers will be able to purchase Pop's Products directly or indirectly, and the right to immediately suspend or revoke any person's or entity's designation as an Authorized Retailer with respect to some or all Pop's Products, with or without cause, warning and in its sole discretion.

I certify that the information submitted in this application is exact and true. I agree to advise Pop's Birding Company immediately of any changes in ownership, address, contact or any other information submitted in this application and condition form. These conditions will remain valid until revoked in writing to Pop's Birding Company.
