Privacy policy

Pop's Birding is a family business. We've been making hummingbird swings, feeders, nectar and wildflower seed since Pops invented the hummingbird swing, and we'd like to treat your information the way we'd want ours treated. This policy explains, in plain language, what we collect when you visit popsbirding.com, buy from us, or get in touch, what we do with it, who we share it with, and the choices you have.
In this policy, "Pop's," "we," "us," and "our" mean Pop's Birding Co, LLC, 2184 Channing Way, #427, Idaho Falls, Idaho 83404, United States. Our online store runs on Shopify.
The short version
- We collect what we need to sell and ship your order, answer your questions, and send the emails you signed up for.
- Our site uses cookies and pixels, including tools from Google, Meta (Facebook and Instagram), and Shopify, to measure how the site is doing and to show our ads to people who might like our products. Under some state laws, that counts as "selling" or "sharing" personal information. If you live in one of those states, you can turn it off any time through Your Privacy Choices, and we honor the Global Privacy Control signal from your browser.
- We don't sell your name, email or address to anyone for money.
- You can ask us to show you, correct, or delete your information by emailing policyadmin@popsbirding.com or calling 888-554-1175.
1. Information we collect
Information you give us
- Orders: your name, shipping and billing address, email, phone number, and what you bought. Card payments are handled by our payment processors (Shopify Payments, which also handles Shop Pay, Apple Pay, and Google Pay). We don't see or store your full card number.
- Customer accounts: your login details, saved addresses, and order history.
- Emails: your email address when you join our newsletter, plus which emails you open and click.
- Questions and chat: whatever you type when you email or call us, use our website chat, or send a question through a form on our site (such as "Ask a Hummingbird Question" or "Still have questions?").
- Subscriptions: if you subscribe to regular deliveries, your delivery schedule, subscription history, and the payment method on file for your subscription.
- Reviews: your name, review, star rating, and any photos you choose to upload. Reviews are public on our site.
- Blog comments: your name, email address, and comment when you comment on our Learning Center. Your name and comment are public; your email address is not. If you choose to get notified of replies, we'll email you when someone responds.
- Retailers and wholesale customers: business name, contact person, business address, email, phone, tax or resale information you provide, and wholesale order history.
- Find a Retailer map: the city or ZIP code you search for.
- Returns and warranty claims: your contact information, order details, and photos or descriptions of the problem.
- Contests and giveaways: if we run one, the entry information described in its official rules.
Information collected automatically
When you browse our site, we and our partners automatically collect information such as your IP address, browser and device type, general location based on your IP address (city or region, not your exact spot), the pages you view, how you got to our site, and what you click and add to your cart. This is collected through cookies, pixels, and similar tools. See section 5.
Information from other sources
We receive order and delivery updates from shipping carriers, payment confirmations and fraud checks from payment processors, and, if you order through Faire, the wholesale order details Faire provides to us.
2. How we use your information
- To take, ship, and support your orders, including returns, refunds, and Lifetime Warranty claims.
- To run customer and wholesale accounts.
- To answer your questions by email, phone, and chat.
- To send order and shipping updates, and, if you signed up, our newsletter and offers.
- To show and manage product reviews and blog comments.
- To understand how people use our site, so we can improve it and our guides.
- To show our ads on other websites and apps, and to measure whether those ads work (see section 4).
- To prevent fraud, keep our site secure, and meet our legal, tax, and accounting obligations.
3. Who we share it with
We share information only with the companies that help us run our business, and in the situations listed below.

We may also share information: when the law requires it, such as to respond to a valid court order; to protect our customers, our business, or others from fraud or harm; and to a buyer or successor if our business is ever sold or reorganized, in which case this policy continues to apply to the information transferred.
4. Advertising, "selling," and "sharing"
We don't sell your name, email, or address to anyone for money. But some of the advertising and analytics tools on our site, including those from Google, Meta, and Shopify, collect information such as your IP address, cookie and device IDs, the pages you visit, and what you add to your cart or buy. They use it to show our ads to you and to people like you on other websites and apps, and to tell us whether our ads worked. When you buy from us, we may also send Meta your contact details from the order, such as your name, email, phone number, and location, in a scrambled (hashed) form so Meta can match the purchase to our ads.
Under the privacy laws of California and several other states, this can count as "selling" or "sharing" personal information, or as "targeted advertising." In the past 12 months, the categories of information disclosed this way were: identifiers (such as IP address and cookie or device IDs), internet activity (pages viewed and site interactions), and commercial information (products viewed, added to cart, or purchased). We do not knowingly sell or share the information of anyone under 16.
How to opt out: the opt-out is available to visitors in the states whose privacy laws give this right.
- Visit Your Privacy Choices (visitors in those states will also see it linked at the bottom of every page).
- Or turn on Global Privacy Control in your browser. When our site receives that signal from a visitor in one of those states, we treat it as a request to opt out.
Opting out doesn't stop you from seeing ads. It means the ads won't be based on what you do on our site. Because these tools work through your browser, you'll need to opt out separately on each browser and device you use.
Shopify, which runs our store, also uses information from our store together with information from other Shopify stores to provide certain services. You can read how Shopify handles personal information in the Shopify Consumer Privacy Policy, and you can make requests to Shopify directly through the Shopify privacy portal.
5. Cookies and similar tools
Cookies are small files your browser stores. We use them to keep your cart and login working (necessary), to remember preferences like your currency, to understand how our site is used (analytics), and for the advertising described in section 4 (marketing). Where our cookie banner or cookie preferences link is shown, you can use it to manage non-essential cookies. You can also block or delete cookies in your browser settings. Some parts of the site, like the cart, may not work if you block every cookie.
Do Not Track: some browsers send a "Do Not Track" signal. Because there isn't an agreed standard for how websites should respond to it, our site doesn't respond to Do Not Track. We do honor Global Privacy Control as described in section 4.
6. Your privacy rights
Depending on where you live, you may have the right to:
- know what personal information we have about you, and get a copy of it;
- correct information that's wrong;
- have your information deleted;
- opt out of the "sale" or "sharing" of your information and of targeted advertising, if your state's law gives you this right (see section 4);
- limit the use of sensitive information (we don't collect sensitive information; see section 9).
We honor requests to know, correct, or delete your information from customers in every U.S. state, not just the states whose laws require it.
How to make a request: email policyadmin@popsbirding.com with the subject "Privacy request," or call us toll-free at 888-554-1175, Monday through Friday, 8:00 a.m. to 5:00 p.m. Mountain Time. To protect your information, we'll confirm your identity by matching details you give us, such as the email and address on your orders, with what we have on file. You can have an authorized agent make a request for you; we'll ask for proof that you gave them permission.
We'll respond within 45 days. If we need more time, we'll tell you why, and how much longer it will take. Some information we have to keep even if you ask us to delete it, such as order records we need for taxes and warranty claims. If that happens, we'll tell you what we kept and why.
If we say no: you can appeal by replying to our decision or emailing policyadmin@popsbirding.com with the subject "Privacy appeal." We'll give you a written answer and our reasons within 45 days. If you're still not satisfied, you can contact your state attorney general.
We will never charge you more, give you worse service, or deny you anything because you used your privacy rights.
7. Customers in Canada
We ship to Canada. When you visit from Canada, you'll see a cookie banner where you can choose whether to allow analytics and advertising cookies, and you can change that choice later. We collect, use, and share your information only for the purposes described in this policy, with your consent, which you can withdraw at any time (though we may then be unable to process an order). You can ask to see the personal information we hold about you and to correct it by contacting us as described in section 6. Our service providers may store and process your information in the United States or other countries, where it may be accessed by courts and authorities under those countries' laws.
8. Visitors from outside the U.S. and Canada
We're based in the United States, and we currently sell and ship only to the U.S. and Canada. If you visit from elsewhere, your information will be processed in the United States.
9. Children and sensitive information
Our store is meant for adults. Kids are welcome to read our hummingbird guides, but we don't knowingly collect personal information from children under 13. If you think a child has given us personal information, please contact us and we'll delete it.
We don't collect sensitive information, such as Social Security numbers, health information, or your precise location. Our Find a Retailer map uses only the city or ZIP code you type in.
10. How long we keep information

11. Emails
If you join our newsletter, we'll send you birding tips and offers. Every marketing email has an unsubscribe link, or you can email us to be removed. After you unsubscribe, we'll still send messages about your orders. We don't send marketing text messages.
12. Keeping your information safe
We use reasonable safeguards to protect your information, and payments are processed by providers that meet payment-card security standards. No website is 100% secure, so we can't promise that information will never be accessed without permission. If that ever happens, we'll notify you as the law requires.
13. Changes to this policy
When our practices change, we'll update this policy and the "Last updated" date at the top. If we make a significant change to how we use your information, we'll post a notice on our site or email you before the change takes effect.
